This privacy policy describes how kerned ltd., which owns or licenses and operates the Pregspect service, processes your personal data. Below you can read about which information we collect, why we collect it, what we do with it and your digital rights under applicable data protection laws.

We may from time to time need to update or change this policy. The latest version of the policy is always available on our website pregspect.com. If you have any questions regarding our policy and how we process your personal data, please contact us by email at hello@pregspect.com.

1. Personal data controller

kerned ltd. (corporate registration number 12250091) is the personal data controller for the services we offer via the web domain pregspect.com. When you pay for one of our services through the payment services PayPal or Klarna, these companies act as personal data controller in relation to you with regard to their delivery of the payment service.

2. How we access personal data

We gain access to your personal data by you personally sharing it with us when you visit our website, when you use our service, when you pay for our service or when you contact us as a user, representative of a customer, supplier or similar. We do not get access to your personal data in any other way than by you providing us with this data.

3. Why do we process personal data about you?

We process your personal data in order to provide you with our services; that is, to enter into or fulfill an agreement with you as a customer (the legal basis here is an agreement with you).

We may also process your personal data in order to promote our services or those of others to you. In such a case, this is done on the legal basis of legitimate interest.

In the event that you pay for any of our services, we will also process your personal data in accordance with accounting legislation (i.e., on the legal basis of a legal obligation).

4.Which data do we collect about you?

We seek to process as little personal data about you as possible. This means that we do not collect more personal data than what is necessary to fulfill the purposes for which the data will be processed. Below, we list exactly which personal data we collect from you based on which of our services you choose to use.

Processing sensitive personal data

In order to use the Pregspect services, you need to share certain data about you and your health. This constitutes sensitive personal data (in the General Data Protection Regulation, this is referred to as “special categories of personal data”), and processing this type of personal data involves more stringent requirements regarding data security compared to processing other forms of personal data. Below, you can read more about when and why this data is necessary for us to deliver our service to you and how we process it, based on which of our services you choose to use.

4.1 Our Best Forecast

When you perform Our Best Forecast, we only ask for the data necessary for the model to predict the most likely delivery date and the baby’s estimated birth weight and birth length. The data we need for this purpose includes:

  • expected delivery date (based on the ultrasound examination)
  • how many children you carry
  • your height, weight and age
  • if you have been pregnant before
  • the baby’s gender (if you have this information)
  • if you smoke
  • your email address

All the above data – with the exception of your email address – qualifies as sensitive personal data. Processing this personal data is necessary for us to provide our service and fulfill our agreement with you. Our agreement with you is the basis for us processing this personal data.

The above personal data will be processed and saved in its entirety for a period of 30 days from when you receive the result for the purpose of fulfilling our obligations arising from the delivery of our service. All data concerning you, with one exception (described in the next sentence), is then de-identified by automatically separating it from your email address and any other forms of data that might identify you. The exception mentioned above is that we continue to process and save your email address as well as the data on the week of your pregnancy and whether or not it is your first pregnancy (so-called parity). This is for the purpose of updating you and promoting targeted offers to you. To summarise, only your email address, week of pregnancy and parity are saved after the above-mentioned 30-day period.

All anonymised data (i.e., that which is no longer personal data) is kept for an unlimited period of time for the purposes of quality assurance, troubleshooting, producing statistics, target group knowledge, service development, etc.

4.2 Our Early Forecast

When you perform Our Early Forecast, we ask for the data necessary for us to predict the most likely delivery date based on the first day of the last period. The data needed for this forecast model includes:

  • when you had your last period
  • the length of your menstrual cycle
  • your height, weight and age
  • if you have been pregnant before
  • if you smoke
  • your email address

All the above data – apart from your email address – qualifies as sensitive personal data. Processing this personal data is necessary for Pregspect to provide our service and fulfill our agreement with you. Our agreement with you is the basis for us processing this personal data.

The above personal data will be processed and saved in its entirety for a period of 24 hours from when you receive the result in order to deliver the service to you. All data concerning you, with one exception (described in the next sentence), is then de-identified by automatically separating it from your email address and any other forms of data that could identify you. The exception mentioned above is that we continue to process and save your email address, data on the week of your pregnancy and whether or not it is your first pregnancy (so-called parity). This is for the purpose of updating you and promoting targeted offers to you. To summarize, only your email address, week of pregnancy and parity are saved after the above-mentioned 24-hour period.

All anonymised data (i.e., that which is no longer personal data) is kept for an unlimited period of time for the purposes of quality assurance, troubleshooting, producing statistics, target group knowledge, service development, etc.

5.  The purposes for our processing of your personal data and the legal bases for such processing

  • Our purpose for processing your personal data is to provide one or more services to you as described above in items 4.1 and 4.2. The legal basis for this is an agreement with you.
  • An additional purpose for processing your personal data (your email address and, where applicable, week of pregnancy and parity) is to be able to promote additional services to you. This is done on the legal basis of legitimate interest.
  • In the event that you pay for a service, we will also process your personal data on the legal basis of legal obligation.

6. Processing personal data upon payment

6.1 Klarna as payment method

We use Klarna as our payment service, which means that Klarna is the personal data controller for everything related to your payment if you choose Klarna as your payment method. As a result, Pregspect will never come into contact with your credit/debit card details, which means that you need to contact Klarna if you have any questions on how they process your data. 6.2 PayPal as payment method

We use PayPal as our payment service, which means that PayPal is the personal data controller for everything related to your payment if you choose PayPal as your payment method. As a result, Pregspect will never come into contact with your credit/debit card details, which means that you need to contact PayPal if you have any questions on how they process your data. 7. Protecting your personal data

We take security very seriously and have routines and procedures in place to ensure that your personal data is processed in the most secure manner possible. For example, access to the systems in which the personal data is stored is limited to the employees who need this data in the context of their work. In addition, we will anonymise your personal data within a very short period of time after we have received it from you, with the exception of your email address and, where applicable, week of pregnancy and parity.

We use secure sockets layer technology (SSL) to encrypt personal data when communicated via the internet. Our website and services are delivered by a managed web service located at our supplier in the United Kingdom. This means that the processing constitutes a third-country transfer as the United Kingdom is not a member of the European Union (EU) or the European Economic Area (EEA). However, the European Commission decided on June 28, 2021, that the United Kingdom exhibits a so-called adequate level of protection with regard to the processing of personal data. This means that the level of protection for processing corresponds to that in the EU/EEA and that personal data can be transferred to and from the United Kingdom in the same way as within the EU.

7.1 Who can access your data?

In addition to those of our employees who need to process personal data for their tasks, we share the data with contracted service providers needed to offer and develop our service. Examples here include suppliers of IT and communication services in order to, for instance, conduct customer surveys and manage email mailing services. These suppliers serve as personal data processors for us. They may only process the data transmitted on our behalf and in accordance with agreements with us and based on our express instructions. See item 11 below for a summary of our personal data processors.

When you visit our website, there is some information about you that we need to process in order for the site to work as intended. This is done using so-called cookies.

9. Your rights

As a registered user, you have several rights when we process personal data about you. If you wish to exercise any of these rights, please contact us using the contact information listed in item 10.

You have the right to exercise the following rights:

Access to personal data

You have the right to know if we process personal data about you and, if so, which personal data. You are entitled to receive records from us containing the personal data we process about you.

Correction and deletion

You have the right to request that we correct or delete any personal data we process about you. Depending on the purpose of the processing, you also have the right to supplement incomplete personal data (e.g., by means of a supplementary statement).

Limitation of processing

Under certain conditions, you have the right to request that we limit our processing of your data. You are always entitled to demand that we do not process your email address for marketing and communication purposes. For example, you may demand a limitation while we check the accuracy of your personal data or if you need your personal data to determine, enforce or defend legal claims (i.e., if you are in a legal dispute).

Right of objection

You have the right to object to our processing of personal data. In the event that you object to the processing of personal data for direct marketing purposes, we will cease processing your personal data. In case you object for other reasons, we will cease processing your personal data if we are unable to present legitimate reasons for further processing.

Right to transfer personal data (data portability)

The right to transfer personal data (data portability) means that you can request your personal data in order to transfer this data to someone else.

Right to lodge a complaint

You have the right to lodge a complaint with the Swedish Authority for Privacy Protection if you believe that we are processing your personal data in an improper manner. You can read more about this on the Swedish Authority for Privacy Protection website: www.imy.se.

If you submit a request to us, we will perform a review of your rights and as far as possible comply with your request.
